MEMORANDUM OF UNDERSTANDING - Yellow Alert Days
Between the Quakertown Community School District
and the Quakertown Community Education Association
This Memorandum of Understanding (hereinafter referred to as the “MOU”) is made by and between the Quakertown Community School District (the “District”) and the Quakertown Community Education Association (the “Association”). The District and Association will be referred to collectively as “the Parties.”
WHEREAS, the District and the Association are parties to a collective bargaining agreement with a term of July 1, 2020 through June 30, 2024 (the “CBA”); and
WHEREAS, the Parties have mutual concerns regarding having adequate staffing to safely supervise students when a building experiences a high number of unfilled absences; and
WHEREAS, the District and the Association, after discussion, desire to work cooperatively to address these issues for the remainder of the 2022-23 school year,
NOW THEREFORE, intending to be legally bound hereby, the parties agree as follows:

In the event of a building closure due to inadequate staffing levels (“yellow alert”) the School District will utilize the PDE-approved Instructional Time Template (submission pending) to provide virtual instruction and services to students on that day. Professional staff members will work and be available during their regularly scheduled work hours, and have the option to decide to provide virtual instruction from their classroom or from home. If teaching from home, professional staff must meet the expectations outlined in the 2022-23 Expectations for Virtual Learning document and remote work expectations document. These days are contractual work days and count as a regular student day. Teachers are expected to provide a combination of direct instruction via live streaming/synchronous opportunities and videos, live student support, and asynchronous work during the day appropriate for the age level and course content of the class. Since yellow alert days are contractual work days, all professional staff members must work unless utilizing a leave day.

Professional Staff members will prepare their students and families for how Yellow Alert closures or weather related emergencies resulting in use of a Flexible Instructional Day will work from a logistical and classroom perspective prior to December 9, 2022. The District will communicate with all families about Yellow Alert closures and how they will be determined upon approval of this MOU.

This MOU expires on June 30, 2023 unless extended by mutual agreement of the parties.
